As used in this Privacy Policy, the terms “Pike” and “Pike Therapeutics”, “we”, “us” and “our” refer to Pike Therapeutics Inc. and its affiliates, which include our vendors, contractors, and agents, unless otherwise stated in this Privacy Policy.

We collect personal information in two ways: automatically and when you provide it to us.

3.1 Information we collect automatically

We automatically collect your information through cookies (a small file placed on your computer or mobile device that recognizes you) – and web beacons (small electronic files that monitor website traffic).

We also automatically collect information about the device(s) you use to access the Website, including MAC address, IP address, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, device type, and device identifiers and device configuration details.

• Information about your visits to the Website, including the full URL clickstream (including date and time recently viewed items and country of residence);
• Website pages and listings you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

We may also use technologies to automatically collect tracking information on your mobile device or your browser. You may request us to stop the collection by disabling cookies through your web browser and clicking unsubscribe through your e-mail.

3.2 Information You Provide Us

We collect information from you if you send us an email, fill out a feedback form, call us, or communicate with us in any other way in order to respond to your request, feedback, or question. 

Some of the information we collect through your use of the Website or communications with us, such as your name, email address, residential address, phone number, social media usernames, and profile pictures may personally identify you. We will treat this information as “Personal Information.”

Our Website allows you to interact with us on various third party social media platforms such as Facebook, Twitter, Instagram, and LinkedIn. When you choose to interact with us via social media platforms, we may automatically collect additional Personal Information from you. These include your personally identifiable information list, gender, location, URL, a biography, any additional image or information. We may also collect your communications with us through the third party social media platforms.

We may also collect records and copies of your correspondence (including e-mail addresses and phone numbers) with us.

3.3 Aggregate or Anonymized Information

We may combine information about use of the Website in an aggregate or anonymous manner to determine trends and improve our service and we may share these data with analytics, search engine or other service providers to help us improve our services.

3.4 No Sensitive Medical or Financial Information

We will not ask for or request any sensitive medical or financial information. Please do not provide such information to us through emails, feedback forms or in any other way.

Our Website applies this privacy policy.  We do not respond to a “Do Not Track” feature or similar signal.

All information you provide to us is stored on our secure servers behind firewalls. We also use encryption technology to protect certain information. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your information, we cannot guarantee against access to your Personal Information by unauthorized third parties.

8. Children’s Privacy

The Website is not intended for and is not directed toward minors under the age of 18. If you are under 18 years of age, you are not permitted to submit any Personal Information to us. The Website is operated from the United States and Canada and the personal information it collects is and stored in these countries.

10.2 California Residents

Cookies policy

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

Disclosures of your personal data

We may have to share your personal data with the parties set out below for the purposes set out in the table above and with business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you, and credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you.

• Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. External third parties

• Service providers acting as processors based in the UK who provide Investor Registrar services, Nominated Adviser and Broker services, and marketing services.
• Professional advisers based in the UK who provide banking, legal, insurance, accounting and auditing services and company secretarial services.
• HMRC, regulators and other authorities acting as processors or joint controllers based in the UK who require reporting of processing activities in certain circumstances.
• Fraud prevention agencies, credit reference agencies, HM Courts & Tribunals Service.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third party service providers to use your personal data for their own purposes, and only permit them to process your personal data for specified purposes and in accordance with our instructions. International transfers

We do not transfer your personal data outside the European Economic Area (“EEA”) to be used by any other party. We do however use US-based cloud email and storage system providers. This will therefore involve transferring your data outside the EEA.

Whenever we transfer your personal data outside the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

• We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
• Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe.
• Where we use providers based in the US, we may transfer data to them if they are part of Privacy Shield which requires them to provide similar protection to personal data shared between Europe and the US.

Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. We will store all the personal information you provide on our secure servers. All electronic transactions you make to or receive from us will be encrypted using SSL technology. Of course, data transmission over the Internet is inherently insecure, and we cannot guarantee the security of data sent over the Internet. You are responsible for keeping your password and user details confidential. We will not ask you for your password.

In addition, we limit access to your personal data to those employees, agents and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Data retention and storage

How long will you use my personal data for?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. We review the personal data that we hold every 12 months.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for accounting, tax and legal purposes. This also helps us, for example, in the event that there is a complaint about our Services, to respond to you in full.

In some circumstances, you can ask us to delete your data: see “Request erasure” below for further information.

In other circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data.

You have the right to:

Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee usually required

Data Subjects have the right to access their personal data and supplementary information. The right of access allows individuals to be aware of and verify the lawfulness of the processing.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive, or requires copies of previously provided information. Alternatively, we may refuse to comply with your request in these circumstances.

In the event of manifestly unfair or excessive requests, we may refuse to respond to the request and any such refusal will be notified to the requester with a reason for the refusal and, in addition, information as to your rights to complain to the ICO or judicial authority within one month of such a request being received.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
